When someone dies because of another person’s negligence, the family is left to deal with grief, funeral arrangements, lost income and a legal process that moves on its own timetable. A Virginia wrongful death claim is the legal mechanism for holding the responsible party accountable and for recovering the financial losses the family now faces.

Mackie Injury Lawyers represents spouses, children, parents and other family members in fatal accident claims across Virginia Beach, Chesapeake, Norfolk, Portsmouth and the wider Hampton Roads area. We handle the investigation, deal with the insurance companies and, where the case requires it, take it to trial in the Virginia Beach Circuit Court.

Who can file a wrongful death claim in Virginia

Virginia does not allow every family member to file. Under Va. Code § 8.01-50, the action is brought by the personal representative of the deceased person’s estate — usually the executor named in the will, or an administrator appointed by the court when there is no will.

The beneficiaries of any recovery are set by Va. Code § 8.01-53, generally in this order:

  • The surviving spouse and children (or grandchildren, where a child has already died)
  • The surviving spouse, where there are no children
  • The parents, where there is no spouse or child
  • Brothers and sisters, and then other blood relatives, in certain circumstances

If you are unsure whether you qualify, we can review the family situation and the estate documents at no cost. If no estate has been opened yet, we can explain the qualification process and what it involves.

What a Virginia wrongful death claim can recover

Va. Code § 8.01-52 sets out the damages a Virginia court can award. They include:

  • Funeral and burial expenses
  • Medical and hospital bills from the final injury or illness
  • Income, benefits and services the deceased would have provided the family
  • Loss of companionship, comfort, guidance and society
  • The deceased person’s pain and suffering between the injury and the death
  • Punitive damages, where the conduct that caused the death was willful or wanton

Virginia does not award damages for the family’s own grief, which is one reason a fatal claim has to be built carefully around the categories the statute recognises. The evidence that supports each category — tax returns, employment records, household contributions, medical records — has to be gathered early.

The deadline is two years

Under Va. Code § 8.01-244, a wrongful death action must be filed within two years of the date of death. That sounds like a long time. It is not. Evidence disappears quickly: vehicles are repaired or sold, surveillance footage is overwritten within weeks, witnesses move, and electronic data from trucks and phones is routinely purged. Reconstructing a fatal collision two years later is far harder than doing it in the first month.

Virginia’s contributory negligence rule

Virginia is one of the few states that still applies pure contributory negligence. If the deceased is found to have been at fault in any degree, a claim can be barred entirely — not reduced, barred. That rule makes the investigation the most important part of a Virginia wrongful death case. Collision reconstruction, phone and vehicle data, dash camera footage, witness statements and scene photographs all have to be secured before the insurer builds its own version of events.

Where Virginia Beach cases are filed

Most fatal claims arising in the city are filed in the Virginia Beach Circuit Court at 2425 Nimmo Parkway. Where a city vehicle, a defective road or a dangerous condition on public property is involved, Virginia law also requires written notice to the locality within a short window under Va. Code § 8.01-222. Missing that notice can end an otherwise valid claim.

Fatal accidents we handle in Virginia Beach

  • Fatal car and truck crashes on I-264, I-64, Virginia Beach Boulevard, Shore Drive and Lynnhaven Parkway
  • Motorcycle, bicycle and pedestrian fatalities
  • Drowning and boating deaths
  • Fatal workplace and construction incidents
  • Nursing home neglect and medical negligence

What to do in the first days

  1. Obtain the death certificate and the medical examiner’s report.
  2. Do not give a recorded statement to any insurance company, including your own.
  3. Preserve the vehicle, the phone and any dash camera or GPS data.
  4. Photograph the scene and collect the names of witnesses while memories are fresh.
  5. Speak to a lawyer before signing a release or accepting an early offer.

How we handle the case

We start with the evidence, not with a settlement demand. That means scene investigation, reconstruction, medical record review and, where the loss involves income or a business, an economist who can put the family’s actual loss into numbers a court will accept. We deal with the insurer so the family does not have to, and we explain each stage in plain language before it happens.

There is no fee unless we recover compensation for your family. The initial consultation is free.
